Employment Law

Harmon & Davies' employment lawyers assist public and private sector employers in understanding and complying with the laws and advise them in resolving disputes so as to avoid costly litigation.

We defend employers in state and federal court litigation related to employment claims, and regularly represent clients before administrative agencies. We have handled virtually every type of discrimination claim including those involving sexual harassment, gender, disability, age, race, religion, and national origin.

We provide legal advice on compliance, business planning, and resolution of difficult human resources problems arising out of state and federal regulations, as well as common laws governing the employment relationship. For example, we have counseled employers in the areas of wage and hour, temporary employment, occupational health & safety, contract and leave rights, benefits, employment related torts, right to privacy, and other evolving employee rights issues.

We counsel clients on establishing affirmative action plans and provide representation during audits, investigations, administrative proceedings and litigation involving affirmative action obligations.

We work with employers in anticipating and resolving employee issues arising with company downsizing and reorganization, mergers and acquisitions, and ordinary business transactions.

We regularly draft and review employment contracts, handbooks, policies, applications, and similar documents to increase their effectiveness and decrease employer exposure to litigation.

We work with employers in meeting their I-9 and related obligations. We counsel employers on complying with the Immigration Reform and Control Act and the Immigration and Nationality Act.

We routinely provide clients with on-site legal awareness training as a means of preventing as many problems as possible before they arise. Training modules are specifically tailored to meet client needs and are regularly presented on topics including, among others, workplace violence, sexual harassment prevention, diversity and hiring/interviewing practices.

Labor Law

Harmon & Davies' labor lawyers serve as an advocate for management in cases arising under the National Labor Relations Act.

We negotiate collective bargaining agreements and provide advice regarding the negotiation process.

We represent management in unfair labor practice proceedings before the NLRB, in labor arbitrations, and in court proceedings to obtain relief from unlawful picketing and related problems.

We are also experienced in the representation of employers during union elections and campaigns, as well as during decertification elections.

We provide on-site legal awareness training tailored to meet the needs of our clients. We have provided training on the topics of union avoidance and the impact of the NLRA on non-union workplaces, among others.
